This Privacy Policy explains how Everuna ("Everuna," "we," "us," or "our") collects, uses, stores, shares, and protects personal information when you visit our website, submit a form, create an account, use the Everuna platform, manage screens, run advertising campaigns, or otherwise interact with our services.

By using our website or services, or by submitting information to us, you agree to the practices described in this Privacy Policy.

1. Who We Are

Everuna operates a digital signage management and local screen advertising platform, including Everuna’s marketing website and customer-facing application. For the purposes of applicable data protection law, Everuna is the data controller for personal data collected through our website and services.

2. Information We Collect

We may collect the following categories of information:

2.1 Information You Provide Directly

  • Contact and lead information: your name, email address, phone number, company name, and any other information you provide when filling out a form on our website.
  • Account information: first name, last name, business name, email address, and password when you create an account. Passwords are processed securely and we do not store plain-text passwords.
  • Billing information: payment and subscription information processed by third-party payment providers such as Stripe. We do not store your full payment card number.
  • Customer content: images, videos, media files, campaign assets, playlists, and other content you upload or submit for use in the platform.
  • Communications: messages, support requests, sales inquiries, and other communications you send to us.
  • SMS/text messaging consent: when you opt in to receive text messages from us, we collect your mobile phone number and your consent preferences, including the date and method of opt-in.

2.2 Information We Collect Automatically

  • Log data: IP address, browser type, pages visited, timestamps, referring URLs, and similar request data.
  • Device data: device identifiers, operating system, browser details, screen resolution, and related technical information.
  • Usage data: how you interact with our website and platform, including features used, content played, campaign performance metrics, proof-of-play logs, and account activity.
  • Cookies and similar technologies: cookies, local storage, session tokens, and preference settings such as your selected theme. See Section 10 for more details.

2.3 Information from Third Parties

We may receive limited information from third-party services that help us operate our website and platform, such as authentication providers, payment processors, analytics providers, cloud infrastructure vendors, email delivery providers, and weather data APIs. We only collect what is reasonably necessary to provide our services.

3. How We Use Your Information

We use personal information to:

  • Respond to inquiries and provide customer support
  • Create and manage your account
  • Provide, operate, maintain, and improve our website and platform
  • Process payments and manage subscriptions
  • Deliver content to screens and run advertising campaigns
  • Generate analytics, proof-of-play reporting, and performance insights
  • Send transactional emails such as receipts, account alerts, and password resets
  • Send product updates, offers, service announcements, and marketing communications via email or SMS, where permitted by law and with your consent where required
  • Send SMS/text messages for service updates, alerts, and marketing where you have opted in to receive such messages

We do not sell your personal information. We do not use customer-uploaded content to train machine-learning models.

4. Marketing Communications

If you submit a contact or lead form, or otherwise provide your email address to us, we may send you information about Everuna services, updates, offers, and local advertising news, where permitted by law. You may opt out of marketing emails at any time by clicking the unsubscribe link in the email or by contacting us at contact@everuna.com.

Even if you opt out of marketing communications, we may still send you transactional or service-related messages, such as account notifications, receipts, security alerts, and password reset emails.

5. SMS / Text Message Communications

5.1 Queue & Waitlist Notifications (Transactional SMS)

When a guest checks in through Everuna's queue module at a venue, they may voluntarily provide their mobile phone number and actively opt in — by checking an unchecked consent box — to receive automated SMS notifications about their queue status. These messages are strictly transactional and tied to that single visit.

  • Message types: a confirmation message when joining the line and a notification when it is their turn. No marketing or promotional messages are ever sent through the queue system.
  • Message frequency: up to 2 messages per visit.
  • Msg & data rates may apply depending on your mobile carrier and plan.
  • Consent is not required to receive queue service at any venue.
  • Opt out: reply STOP to any message to cancel. Reply HELP for assistance.

5.2 Business & Marketing SMS

Separately, if you are a venue partner, advertiser, or other business contact and you opt in to receive SMS communications from Everuna — whether through a web form, text keyword, or other opt-in mechanism — you consent to receive recurring automated SMS/text messages including service updates, alerts, and marketing messages. Consent is not a condition of purchasing any product or service.

  • Message frequency: message frequency varies based on your activity and preferences.
  • Opt out: reply STOP to any SMS message to unsubscribe at any time. You will receive a confirmation message and no further messages will be sent.
  • Help: reply HELP to any SMS message for assistance, or contact us at contact@everuna.com.
  • Message and data rates: standard message and data rates may apply depending on your mobile carrier and plan.
  • Carrier liability: mobile carriers are not liable for delayed or undelivered messages.

5.3 Mobile Information Sharing

No mobile information — including your mobile phone number and SMS opt-in consent — will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties under any circumstances, except as strictly necessary to deliver the messages you requested.

We use Telnyx to send SMS messages on our behalf. Your mobile phone number is shared with Telnyx solely for message delivery and is not used for any other purpose. For more information, see Telnyx's privacy policy at telnyx.com/privacy-policy.

6. How We Share Your Information

We do not sell personal information. We may share your information with:

  • Service providers: vendors that help us operate our website, platform, payments, hosting, analytics, authentication, customer communications, and email delivery.
  • Legal compliance: if required by law, subpoena, court order, or other valid legal process.
  • Protection of rights: where we believe disclosure is necessary to protect the rights, property, or safety of Everuna, our users, customers, or the public.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of all or a portion of our assets.

7. Third-Party Services We Use

We use third-party providers that may process personal data on our behalf, including:

  • Stripe — payment processing and subscription billing
  • Supabase — authentication, database, and platform infrastructure
  • Resend — email delivery and contact audience management
  • Telnyx — SMS/text message delivery
  • Google Analytics — website usage analytics
  • Vercel — website hosting and infrastructure
  • Cloud storage and infrastructure providers — media storage and service operations
  • Weather data providers — where weather-related platform features are enabled

These providers are permitted to use personal information only as necessary to provide services to us and are expected to protect it appropriately. We encourage you to review their privacy policies where applicable.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

  • Account data: retained while your account is active and for up to 90 days after account closure to allow for account recovery and compliance needs, after which it is deleted or anonymized.
  • Billing records: may be retained for up to 7 years for tax, accounting, and legal compliance purposes.
  • Proof-of-play logs and analytics: retained for up to 24 months, after which they may be aggregated or anonymized.
  • Contact and lead form submissions: may be retained in our email systems and marketing tools until you request deletion or unsubscribe, unless we must keep them for legal or operational reasons.

9. Your Rights and Choices

Depending on your location, you may have the right to:

  • Access: request a copy of the personal data we hold about you
  • Correction: request correction of inaccurate or incomplete data
  • Deletion: request deletion of your personal data, subject to legal obligations
  • Restriction: request restriction of processing in certain circumstances

  • Preference cookies: remember settings such as theme and display preferences
